As of this morning the legislature is in recess and all eyes are on Governor Brewer. The governor can choose to sign, veto or line item veto the legislation passed early this morning. The legislation does not contain the Governor’s temporary sales tax increase. Below is running commentary concerning the last 48 hours of our Arizona Legislature (you can scroll down to read the recap).

Wednesday, July 1, 2009–LEGISLATIVE OVERTIME!!

7:31 AM: Legislature adjourns Sine Die. Governor Brewer expected to line item veto budget and call Special Session. State will continue business as usual.

1:25 AM: Senate moving non-budget related bills through. House expected to vote on returned bills into the early morning. Budget has passed House & Senate without the sales tax. No word yet on how Governor Brewer expects to respond. Will she line item veto? Or flat veto entire deal? The suspense is too much for AEN’s resident night owl, who is tapping out at 1:25 AM.

10:05 PM: Rep. Yarbrough explains long delay: Review of HB 2644 revealed an error. House retains HB 2644 on calendar. Session continues with 3rd read. Rep. Biggs takes the chair. Adams amendment to HB 2644 receives a DO PASS.

9:35 PM: House called to order for Committe of the Whole#2–here we go again. All bills from prior read refered to as “engrossing”. That’s one way of looking at it….
8:44 PM: House called to order. Begins votes:
HB 2643 Discussion: Kavanaugh does not yield to a question from Rep. Schapira. Rep. Schapira asks: Does HB 2643 repay roll over payment to k-12 ed system? Schapira states, outside of the sweeps, no money to repay $300 roll over payment to ed system. In addition to cuts, a $300 million loss in the striker. Payment not being repaid in HB 2643.

4:32 PM: Arizona is less than 8 hours away from the budget deadline. Governor Brewer’s 1-cent tax increase–part of her 5-part budget plan–failed in Senate. Governor has said she will not sign a budget without it. Word on the wire is she’s been working behind the scenes, along with Speaker of the House Rep. Kirk Adams and Senate President Bob Burns to secure votes to pass budget.

Note: Your AEN team hasn’t come up with a sound reason as to why Senator Burns would move BUDGET bills OFF of the Senate Appropriations agenda and ONTO the Senate Education agenda. But considering the way todays’ first Appropriation’s morning vote went, it may have been perceived as though these bills didn’t stand a chance of making it out of committee. Sen Harper was already asking to go on record as being opposd to any bill with a tax increase.

5:22 PM: Senate passes SB 1196: Education Omnibus. Sen Aboud LD 28 asks, “Why aren’t we voting on the budget in Appropriations?” as she votes “no”.
