Arizona Supreme Court case filed by Governor Jan Brewer on June 16, 2009. The Governor seeks to compel Arizona Senate President Robert Burns and Speaker of the House Kirk Adams to advance their recent budget bills for her consideration – oral arguments were heard beginning at 10am on June 23, 2009.

Update June 23, 2009:
The Supreme Court claimed jurisdiction today and declined to refer Brewer v. Burns to a lower court.
In her ruling, Cheif Justice Ruth McGregor declined to compel the House Speaker Kirk Adams and Senate President Robert Burns to deliver the FY 2009-2010 legislation to Governor Brewer in part due to the “unique circumstances” of the situation. She did note, however, that future legislation must be delivered to the governor’s office without delay.
While the lawyer for the legislature conceded that the bills had been withheld from the Governor in an attempt to gain political leverage, his position that the bills would be delivered by June 30th played a part in the judge’s decision not to set a court-mandated deadline.
